This Privacy Policy applies to personal information collected in connection with business-to-consumer transactions, business-to-business transactions, dealer communications, distributor communications, OEM communications, customer support, warranty communications, returns, ecommerce transactions, account activity, website analytics, online forms, and other interactions with the Services.

This Privacy Policy is intended to provide clear notice of our privacy practices. By accessing or using the Services, you acknowledge that you have had an opportunity to review this Privacy Policy. Your use of the Services may also be subject to separate Terms and Conditions, Shipping Policy, Returns Policy, Warranty Policy, Cookie Policy, supplemental privacy notices, or other notices posted by KFS.

This Privacy Policy does not create contractual rights except where required by applicable law. Nothing in this Privacy Policy limits any rights, remedies, obligations, or protections that cannot be limited or waived under applicable law.

  • Information processed by third parties under their own privacy notices, terms, or legal obligations.

KFS does not control and is not responsible for the privacy practices, security practices, or data handling of third-party websites, platforms, payment processors, marketplaces, shipping providers, social media services, advertising networks, analytics providers, or other third-party services, even if they are linked to or accessible through the Services. Third-party privacy practices are governed by their own privacy notices.

We collect personal information only as reasonably necessary for lawful business, ecommerce, customer service, security, compliance, legal, and operational purposes. The categories of personal information we collect may vary depending on how you interact with the Services.

  • Account activity information; and
  • Information used to maintain account security.

You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account.

  • Products viewed, selected, purchased, returned, exchanged, repaired, or serviced;

  • Invoice information;
  • Purchase order information;
  • Shipping and delivery information;
  • Warranty registration information;
  • Return merchandise authorization information;

  • Pricing tier information, including OEM, Distributor, Stocking Dealer, Dealer, and Retail classifications, where applicable;

  • Other commercial information related to your transactions with KFS.

D. Payment and Billing Information

  • Transaction authorization details;
  • Fraud screening information;
  • Chargeback or dispute information;

  • Payment confirmation information.

Payment card information is generally processed by third-party payment processors. KFS generally does not store full payment card numbers through the Services unless expressly stated or legally required.

E. Shipping, Delivery, and Fulfillment Information

  • Carrier and tracking information;
  • Delivery status;
  • Fulfillment instructions;
  • Customs, duties, export, import, or international shipping information, where applicable;
  • Delivery exception information; and

F. Dealer, Distributor, OEM, and Business Verification Information

  • Tax exemption or resale certificate information;
  • Business license information;
  • Federal firearms license or related business credential information, where applicable;
  • Authorized purchaser or representative information;
  • Credit, trade, or account approval information;
  • Pricing tier eligibility information; and
  • Other information needed to evaluate, approve, maintain, or service a business account.

G. Compliance, Safety, and Legal Information

  • Information required to comply with applicable laws, regulations, orders, sanctions, export controls, tax rules, customs requirements, and product restrictions;
  • Information used to verify eligibility to purchase, receive, or access certain products or services;
  • Information related to restricted, regulated, controlled, or compliance-sensitive products;

  • Website usage patterns;
  • Dealer, distributor, OEM, or customer relationship status; and
  • Other preferences inferred from your interactions with the Services.

K. Sensitive Personal Information

We may collect limited sensitive personal information where reasonably necessary for lawful business, security, fraud prevention, compliance, legal, or account administration purposes. Depending on your interaction with KFS, this may include account login credentials, precise information required for regulated transactions, government-issued identification information, tax-related information, business credential information, or other information treated as sensitive under applicable law.

We do not use sensitive personal information for the purpose of inferring characteristics about you unless permitted by applicable law.

5. Sources of Personal Information

We may collect personal information from the following sources:

  • You: When you create an account, place an order, submit a form, request support, register a warranty, request a return, communicate with us, or otherwise provide information directly to KFS;
  • Your Business or Organization: When a dealer, distributor, OEM, employer, or business account provides information related to authorized representatives, purchasers, account users, or contacts;
  • Our Services: Through website activity, ecommerce transactions, customer portals, cookies, analytics tools, logs, and similar technologies;
  • Service Providers: Such as payment processors, shipping providers, fraud prevention vendors, IT vendors, analytics providers, and customer support vendors;
  • Business Partners: Including authorized dealers, distributors, OEM partners, commercial customers, manufacturers, fulfillment partners, and warranty partners;
  • Public or Government Sources: Such as business registries, license databases, sanctions lists, restricted party lists, regulatory databases, or other lawful public sources; and
  • Other Third Parties: Where permitted by law and consistent with this Privacy Policy.

6. How We Use Personal Information

We use personal information for lawful business purposes consistent with this Privacy Policy, including to:

  • Provide, operate, maintain, and improve the Services;
  • Create, administer, authenticate, and secure accounts;
  • Process and fulfill orders, payments, shipments, returns, exchanges, repairs, and warranties;
  • Confirm order details, shipping information, delivery status, and customer instructions;
  • Manage customer, dealer, distributor, OEM, wholesale, retail, and business accounts;
  • Determine account eligibility, pricing tier eligibility, credit status, business verification status, or transaction approval status;
  • Provide customer service, technical support, warranty support, account support, and product support;
  • Communicate transactional notices, confirmations, updates, security alerts, policy updates, and service-related messages;
  • Respond to inquiries, forms, requests, complaints, and feedback;
  • Detect, prevent, investigate, and respond to fraud, misuse, unauthorized access, suspicious activity, security incidents, or unlawful conduct;

We do not use personal information for purposes that are incompatible with the purposes described in this Privacy Policy without providing additional notice or obtaining consent where required by law.

7. How We Share and Disclose Personal Information

We may share personal information with the following categories of recipients for legitimate business, operational, legal, compliance, security, and transactional purposes:

  • Service Providers and Contractors: Payment processors, hosting providers, cloud service providers, IT vendors, cybersecurity providers, analytics providers, email and communications vendors, customer support platforms, fraud prevention services, database providers, ecommerce platforms, and other vendors that process information on our behalf.
  • Shipping, Fulfillment, and Logistics Providers: Carriers, freight services, fulfillment partners, customs brokers, logistics vendors, delivery services, and related service providers.
  • Payment and Financial Services Providers: Payment processors, banks, card networks, fraud screening providers, chargeback processors, tax processors, and related financial service providers.
  • Business Partners: Authorized dealers, distributors, OEM partners, commercial customers, manufacturers, product support partners, warranty partners, and fulfillment partners where necessary to complete transactions or support business relationships.
  • Analytics Providers: Providers that help us measure website activity, analyze Services usage, improve website performance, understand customer interactions, and improve business operations, including Google Analytics.
  • Legal, Regulatory, and Compliance Recipients: Government authorities, regulators, law enforcement, courts, customs authorities, tax authorities, auditors, insurers, legal advisors, compliance advisors, or other parties where required or permitted by law.
  • Security and Fraud Prevention Recipients: Fraud prevention vendors, cybersecurity providers, identity verification providers, restricted party screening providers, and other parties involved in protecting the Services, transactions, customers, and business operations.
  • Corporate Transaction Recipients: Parties involved in a merger, acquisition, reorganization, financing, sale of assets, bankruptcy, due diligence review, or similar corporate transaction.
  • With Your Direction or Consent: Parties to whom you direct us to disclose information or where you otherwise consent to disclosure.

We require service providers and contractors to use personal information only as necessary to provide services to KFS or as otherwise permitted by law.

8. Cookies, Google Analytics, and Similar Technologies

We and our service providers may use cookies, pixels, tags, scripts, log files, local storage, and similar technologies to operate the Services, remember preferences, support ecommerce functionality, improve performance, analyze website activity, prevent fraud, secure accounts, and support business operations.

We use Google Analytics to understand site usage and improve performance. Google Analytics may collect information such as IP address, device and browser information, pages viewed, referring/exit pages, and interactions with the Services. Google processes this information under its own terms and privacy practices. You can learn more about Google Analytics controls through Google’s resources (e.g., browser controls and Google’s opt-out tools), though such tools may not affect all tracking technologies.

Cookies and similar technologies used through the Services may include:

  • Strictly Necessary Cookies: Used to operate the Services, enable shopping cart functions, process transactions, authenticate users, maintain security, and provide core functionality;
  • Performance and Analytics Cookies: Used to understand how visitors use the Services and improve functionality, performance, and user experience, including through Google Analytics; and
  • Preference Cookies: Used to remember user settings, account preferences, and browsing preferences.

You may be able to control cookies through your browser settings or device settings. If you disable certain cookies, some features of the Services may not function properly.

To limit Google Analytics tracking, you may use tools made available by Google, including the Google Analytics opt-out browser add-on, where available for your browser. Browser-based settings and third-party opt-out tools may not affect all tracking technologies or all third-party services. 9. Privacy Choices; Sale/Share; Targeted Advertising; and Opt-Out Signals

Privacy Choices and Opt-Outs. We do not sell personal information for money. Depending on how our sites and technologies are configured, and depending on applicable law, certain disclosures or opt-out rights may apply to activities that some laws define broadly as “sale,” “sharing,” or “targeted advertising.” Where applicable law requires us to provide opt-out mechanisms, including honoring opt-out preference signals, we will do so. Payment transactions may be processed by third-party payment processors, card networks, banks, fraud prevention vendors, or other financial service providers. These providers may collect and process payment information according to their own privacy notices, security practices, and legal obligations.

KFS may receive limited payment-related information, such as payment confirmation, transaction status, authorization details, billing information, fraud screening results, chargeback information, and records needed for accounting, tax, compliance, customer service, or dispute resolution purposes.

11. Dealer, Distributor, OEM, and Business Account Information

If you interact with KFS as a dealer, distributor, OEM customer, commercial customer, authorized purchaser, account administrator, business representative, or other business contact, we may collect, use, and disclose business contact information and account information for business relationship management, account approval, order processing, pricing tier administration, compliance verification, payment, credit review, tax documentation, shipment, warranty support, reporting, and contract administration.

12. Pricing Tiers

KFS may maintain pricing tiers for qualifying accounts, including OEM, Distributor, Stocking Dealer, Dealer, and Retail tiers, as applicable. Pricing tier eligibility may depend on business verification, account approval, order volume, contractual obligations, product category, compliance status, tax documentation, resale documentation, credit status, and other criteria established by KFS.

KFS may modify, suspend, revoke, or reclassify pricing tier eligibility where necessary for business, compliance, legal, credit, operational, or account management reasons.

13. Firearms, Regulated Products, and Legal Compliance

Some products or transactions may be subject to federal, state, local, or international laws, regulations, restrictions, licensing requirements, export controls, import controls, sanctions, product restrictions, shipping limitations, or other legal requirements.

We may collect, use, retain, and disclose personal information as reasonably necessary to evaluate, process, restrict, cancel, deny, document, or comply with transactions involving firearms-related products, firearm accessories, optics, parts, regulated goods, restricted goods, controlled goods, or compliance-sensitive products.

KFS may deny, cancel, restrict, delay, or place a hold on any transaction where KFS determines, in its discretion, that such action is necessary or appropriate for legal, regulatory, compliance, fraud prevention, security, safety, operational, or business reasons.

14. Shipping, Fulfillment, and Transaction Information

We may use and disclose personal information to process orders, confirm availability, communicate shipping status, fulfill delivery, manage delays, process returns, administer warranties, handle customer service inquiries, and maintain transaction records.

Shipping times, delivery estimates, inventory availability, and fulfillment information may depend on product availability, carrier performance, compliance review, payment authorization, customer information accuracy, regulatory requirements, and other operational factors.

If an order cannot be fulfilled, is delayed, or must be canceled for legal, compliance, operational, inventory, payment, or safety reasons, we may use your contact and transaction information to provide notices, request instructions where required, process refunds where applicable, or maintain records of the transaction.

15. Data Retention

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, including to:

  • Provide the Services and maintain business relationships;
  • Complete transactions and maintain accurate records;
  • Administer customer, dealer, distributor, OEM, wholesale, retail, and business accounts;
  • Comply with legal, regulatory, tax, accounting, customs, export, import, sanctions, recordkeeping, and reporting requirements;
  • Resolve disputes, respond to inquiries, and enforce agreements;
  • Maintain security, prevent fraud, and protect rights, safety, and property;
  • Support warranty, return, repair, customer service, and product support obligations; and
  • Maintain records reasonably necessary for business continuity and legal compliance.

Retention periods may vary depending on the nature of the information, the context in which it was collected, the relationship involved, transaction history, account status, legal requirements, and operational needs.

When personal information is no longer required, we take reasonable steps to delete, de-identify, aggregate, or otherwise dispose of it in accordance with our data retention practices and applicable law.

16. Security Safeguards

We implement reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, disclosure, alteration, destruction, loss, misuse, or other improper handling.

These safeguards may include access controls, account authentication, vendor management, network protections, monitoring, encryption where appropriate, internal policies, employee training, and other security measures appropriate to the nature of the information and business operations.

Despite these safeguards, no website, system, data transmission, or storage environment can be guaranteed to be 100% secure. You use the Services at your own risk and are responsible for maintaining the security and confidentiality of your account credentials.

17. State Privacy Rights

Certain U.S. state privacy laws provide residents of those states with rights regarding personal information when those laws apply to a business. These rights may include the right to request access, correction, deletion, portability, information about data practices, or the ability to opt out of certain uses of personal information, depending on the applicable law.

KFS may not be subject to every state consumer privacy law because many such laws apply only to businesses that meet specific revenue, data-volume, data-sale, data-sharing, or other statutory thresholds.

Where a state privacy law applies to KFS and grants you rights regarding your personal information, KFS will respond to applicable privacy requests as required by law. Where a state privacy law does not apply, KFS may still respond to privacy-related inquiries at its discretion, subject to legal, operational, security, fraud-prevention, transaction, warranty, tax, accounting, and recordkeeping requirements.

Non-Discrimination. Where applicable law provides privacy rights, we will not unlawfully discriminate against you for exercising those rights.

18. Notice Regarding California Privacy Law

California privacy laws apply to certain businesses depending on statutory criteria, which can change over time (including by inflation adjustments). Where California privacy law applies to our activities, we will provide California residents the rights and notices required by law and respond to verified requests within legally required timeframes.

KFS does not sell personal information for money. KFS does not knowingly sell or share personal information of individuals under 18 years of age.

KFS will periodically review its privacy obligations and may update this Privacy Policy, website functionality, or privacy request processes if its operations, legal obligations, use of analytics or advertising technologies, or applicable law changes.

19. Sensitive Personal Information

We may collect, use, and disclose sensitive personal information only as reasonably necessary and proportionate for lawful business, security, fraud prevention, account access, compliance, legal, or operational purposes.

Sensitive personal information may include account login credentials, government-issued identification information, tax-related information, business credential information, precise information necessary for regulated transactions, or other information treated as sensitive under applicable law.

We do not use sensitive personal information for the purpose of inferring characteristics about you unless permitted by applicable law.

20. How to Submit Privacy Requests

To submit a privacy inquiry, request information about KFS’s privacy practices, ask about Google Analytics or website technologies, or exercise a privacy right that applies to you under applicable law, you may contact us using any of the following methods:

KFS does not currently provide a separate online Privacy Request Form. If KFS later makes a Privacy Request Form available, KFS may update this Privacy Policy or provide the form through the Services.

We may need to verify your identity before processing a request. Verification may require matching information you provide with information we maintain or requesting additional information reasonably necessary to verify your identity and protect against fraudulent or unauthorized requests.

We will respond to applicable privacy requests within the time required by applicable law. If a particular privacy law does not apply to KFS or to your request, we may respond at our discretion and may decline the request where permitted by law.

21. Authorized Agents

Where permitted by applicable law, you may designate an authorized agent to submit a privacy request on your behalf. We may require the authorized agent to provide proof of authorization and may also require you to verify your identity directly with us.

We may deny a request from an authorized agent if we cannot verify the agent’s authority to act on your behalf or if the request does not satisfy applicable legal requirements.

22. Appeals

Some state privacy laws provide a right to appeal a business’s decision regarding a privacy request when those laws apply. If an applicable privacy law provides you with an appeal right and KFS denies your privacy request, you may appeal our decision by contacting us at legal@kfsindustries.com and including “Privacy Appeal” in the subject line.

KFS will review and respond to appeals where required by applicable law.

23. Marketing Communications

We may send marketing communications, promotional messages, product updates, or business communications where permitted by law. You may opt out of marketing emails by using the unsubscribe link included in the email or by contacting us using the information in this Privacy Policy.

Even if you opt out of marketing communications, we may still send transactional, service-related, security, legal, compliance, account, order, warranty, return, or other non-marketing communications.

24. Children’s Privacy

The Services are intended for adults and are not directed to children or minors under 18 years of age. KFS does not knowingly collect personal information from individuals under 18 years of age through the Services.

KFS does not knowingly sell or share personal information of individuals under 18 years of age.

If you believe that a child or minor has provided personal information to KFS through the Services, please contact us using the information in this Privacy Policy so that we may take appropriate action.

25. Third-Party Websites and Services

The Services may contain links to third-party websites, marketplaces, payment services, shipping providers, social media platforms, analytics providers, advertising networks, embedded content, or other third-party services.

KFS does not control and is not responsible for the privacy practices, security practices, content, policies, or data handling of third-party services. Your interactions with third-party services are governed by the privacy notices, terms, and policies of those third parties.

26. International Users

KFS is based in the United States, and the Services are operated from the United States. KFS may sell products and conduct business in the United States and internationally, including B2C and B2B transactions, where permitted by law.

If you access the Services from outside the United States, you understand that your personal information may be transferred to, stored in, accessed from, or processed in the United States and other jurisdictions where data protection laws may differ from those in your country of residence.

Where required by applicable law, we will implement appropriate safeguards for international transfers of personal information.

If you are located in a jurisdiction that provides additional privacy rights, you may contact us using the information in this Privacy Policy to request information about rights that may apply to you.

KFS maintains procedures designed to evaluate and respond to suspected security incidents involving personal information.

If we determine that a security incident requires notice under applicable law, we will provide notices to affected individuals, regulators, law enforcement, or other parties without unreasonable delay where required by law.

28. De-Identified, Aggregated, and Anonymous Information

We may use personal information to create de-identified, aggregated, or anonymous information. We may use and disclose such information for lawful business purposes, including analytics, reporting, product improvement, operational planning, and research.

Where required by applicable law, we will maintain and use de-identified information in de-identified form and will not attempt to re-identify such information except as permitted by law.

We may use automated tools to support fraud prevention, security, analytics, account administration, transaction review, compliance screening, inventory planning, or business operations.
